Liability restriction
Users have no right to sue the Owner for damages unless otherwise expressly indicated, and this is without prejudice to any applicable statutory product responsibility requirements (or any natural or legal person acting on its behalf).

As long as the User uses this Website appropriately and correctly, this does not apply to damages to life, health, or physical integrity, damages resulting from the breach of an essential contractual obligation, such as any obligation strictly necessary to achieve the purpose of the contract, and/or damages resulting from intent or gross negligence.

Unless damages are caused by purpose or gross negligence, or they endanger life, health, or physical integrity, the Owner is only accountable for usual and foreseeable damages at the time the contract was signed.

Users in Australia Liability restriction
Nothing in these Terms excludes, limits, or modifies any guarantee, condition, warranty, right, or remedy that the User may have under the Competition and Consumer Act 2010 (Cth) or any comparable State or Territory legislation and that cannot be excluded, limited, or modified (non-excludable right). To the fullest extent permitted by law, our liability to the User, including liability for a breach of a non-excludable right and liability not otherwise excluded under these Terms of Use, is limited to re-performance of the services or payment of the cost of having the services supplied again, at the Owner's sole discretion.

Disclaimer of Warranties for US Users
This Website is offered on a "as is" and "as available" basis. The Service is used at the user's own risk. To the fullest extent permitted by applicable law, the Owner expressly disclaims all express, implied, statutory, and other conditions, representations, and warranties, including, but not limited to, any implied warranty of merchantability, fitness for a particular purpose, or non-infringement of third-party rights. No oral or written advice or information gained by User from Owner or via the Service will create any warranty unless expressly expressed above.

Without limiting the foregoing, the Owner, its subsidiaries, affiliates, licensors, officers, directors, agents, co-branders, partners, suppliers, and employees make no warranty that the content is accurate, reliable, or correct; that the Service will meet User's needs; that the Service will be available at any specific time or location, uninterrupted or secure; that any defects or errors will be corrected; or that the Service is free of viruses or other harmful components. Any content downloaded or otherwise acquired through the use of the Service is done so at the user's own risk, and the user is solely responsible for any damage to the user's computer system or mobile device, as well as any data loss, that results from such download or use of the Service.

The Owner makes no warranty, endorsement, guarantee, or accepts responsibility for any product or service advertised or offered by a third party through the Service or any hyperlinked website or service, and the Owner will not be a party to or monitor any transaction between Users and third-party providers of products or services.

The Service may become inoperable or incompatible with the User's web browser, mobile device, and/or operating system. The Owner is not liable for any perceived or actual damages resulting from the Service's content, operation, or use.

Certain implied guarantees cannot be excluded or limited under federal law, some states, or other jurisdictions. Users may be exempt from the exclusions listed above. This Agreement provides Users with specific legal rights, and Users may also have other rights that differ by state. This agreement's disclaimers and exclusions shall not apply to the extent prohibited by relevant legislation.

Liability restrictions
To the greatest degree authorized by relevant law, the Owner, its subsidiaries, affiliates, officers, directors, agents, co-branders, partners, suppliers, and employees shall not be liable for

any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the Service; and any damage, loss, or injury resulting from hacking, tampering, or other unauthorized access or use of the Service or User account or the information contained therein; In no event shall the Owner, its subsidiaries, affiliates, officers, directors, agents, co-branders, partners, suppliers, and employees be liable for any claims, proceedings, liabilities, obligations, damages, losses, or costs in excess of the amount paid by User to the Owner under this agreement in the preceding 12 months, or the duration of this agreement between the Owner and User, whichever is shorter.
This limitation of liability clause shall apply to the fullest extent authorized by relevant law, regardless of whether the alleged responsibility is based on contract, tort, negligence, strict liability, or any other basis, even if the Owner has been notified of the possibility of such damage.

Because some jurisdictions may not provide the exclusion or limitation of incidental or consequential damages, the limitations or exclusions set forth above may not apply to User. The conditions grant User specific legal rights, and User may also have other rights that vary by jurisdiction. The terms' disclaimers, exclusions, and liability limitations shall not apply to the extent prohibited by applicable law.

Indemnification
The User agrees to defend, indemnify, and hold harmless the Owner and its subsidiaries, affiliates, officers, directors, agents, co-branders, partners, suppliers, and employees from and against any and all claims or demands, damages, obligations, losses, liabilities, costs or debt, and expenses, including, but not limited to, legal fees and expenses, arising from the User's use of the Site.

User's use of and access to the Service, including any data or content transmitted or received by User; User's violation of these terms, including, but not limited to, User's breach of any of the representations and warranties set forth in these terms; User's violation of any third-party rights, including, but not limited to, any right of privacy or intellectual property rights; User's violation of any statutory law, rule, or regulation; any content that is submitted for inclusion on the Service;

Common clauses
There is no waiver. The omission of the Owner to assert any right or provision under these Terms does not constitute a waiver of that right or provision. No waiver shall be deemed a subsequent or continuing waiver of such or any other term.

Service disruption
To provide the highest possible level of service, the Owner reserves the right to stop the Service for maintenance, system updates, or other changes, and will notify Users accordingly.

Within the bounds of the law, the Owner may also choose to suspend or cancel the Service entirely. If the Service is discontinued, the Owner will work with Users to ensure that Personal Data or information is removed in line with relevant legislation.

Furthermore, the Service may be unavailable due to factors beyond the Owner's reasonable control, such as "force majeure" (eg. labor actions, infrastructural breakdowns or blackouts etc).

Reselling services
Users are not permitted to reproduce, duplicate, copy, sell, resell, or exploit any component of this Website or its Service without the Owner's express prior written consent, which may be granted directly or through a legitimate resale program.

Policy on Privacy
Users can read the Website's privacy policy to learn more about how their Personal Data is used.

Rights to Intellectual Property
Any intellectual property rights associated to this Website, such as copyrights, trademark rights, patent rights, and design rights, are the sole property of the Owner or its licensors.

The Owner or its licensors own all trademarks and other marks, trade names, service marks, wordmarks, drawings, pictures, or logos appearing in connection with this Website and or the Service.

The aforementioned intellectual property rights are protected by applicable legislation or international intellectual property treaties.

Modifications to these Terms
The Owner maintains the right to change or amend these Terms at any time. In such situations, the Owner will notify the User of the modifications in a timely manner.

Such modifications will have no effect on the User's relationship in the future.

Continued use of the Website and/or the Service by the User indicates acceptance of the amended Terms.

If any party does not accept the new Terms, either party may cancel the Agreement.

If applicable law requires it, the Owner will identify the date on which the updated Terms will take effect.

Contract assignment
The Owner retains the right to transfer, assign, dispose of, or subcontract any or all of his or her rights under these Terms. Changes to these Terms will be subject to these provisions.

Users may not assign or transfer any of their rights or obligations under these Terms without the prior consent of the Owner.

Contacts All communications relating to the use of this Website must be sent to the address specified in this document.

Severability
If any of these Terms is considered or becomes invalid or unenforceable under applicable law, the invalidity or unenforceability of such provision will not impact the validity of the remaining terms, which will continue to be in full force and effect.

EU Clients
If any term of these Terms is or is considered void, invalid, or unenforceable, the parties will do their best efforts to reach an amicable agreement on valid and enforceable provisions to replace the void, invalid, or unenforceable parts.

If this is not done, the void, invalid, or unenforceable provisions will be replaced by the appropriate statutory provisions, if allowed or indicated by the applicable legislation.

Without limiting the foregoing, the nullity, invalidity, or impossibility of enforcing a specific provision of these Terms shall not render the entire Agreement null and void, unless the severed provisions are essential to the Agreement, or of such importance that the parties would not have entered into the contract if they had known that the provision would not be valid, or in cases where the remaining provisions would impose an unacceptable hardship on any of the parties.

US Customers
Any such invalid or unenforceable provision will be interpreted, construed, and changed to the degree necessary to make it valid, enforceable, and consistent with its original intent. These Terms constitute the complete agreement between Users and the Owner regarding the subject matter hereof, and supersede all other communications, including but not limited to all prior agreements, between the parties regarding such subject matter. These Terms will be enforced to the greatest degree possible under the law.

Governing Legislation
The law of the place where the Owner is based, as revealed in the relevant section of this document, governs these Terms, without respect to conflict of laws principles.

European Customers Are Exempt
Regardless of the foregoing, if the User qualifies as a European Consumer and has their habitual abode in a nation where the law provides for a higher level of consumer protection, such higher standards shall take precedence.

Jurisdictional venue
The courts in the place where the Owner is based have sole jurisdiction over any dispute arising from or related to these Terms, as stated in the relevant section of this document.
